agree to the use of the following Board property, herein referred to as “Premises”. 1201 Klosterman Road, Tarpon Springs, FL 34689 – referred to as the West Klosterman Preserve In consideration of the use of the Premises and other good and valuable consideration, __________(individual or group named above) agrees to indemnify and save and hold harmless the Board, WKPG, its agents, employees and representatives to release and accept all liability arising out of or resulting from any claim for damages, accident, illness, sickness and personal injuries, including death, occurring to persons or occurring to property of others during the time of any use of or presence on the Premises. __________(individual or group named above) agrees to reimburse the Board or WKPG for any expense the Board or WKPG may incur in defending any such claim that may result for the __________(individual or group named above) use of the facilities, including attorney’s fees, costs, and payment of any settlement or judgment. Nothing herein is intended to be, nor shall be, construed as either (i) a waiver of sovereign immunity by Board, WKPG, its agents, employees and representatives; or (ii) consent by either party to be sued by a third party regarding the property use that is the subject of this Agreement.
